The new locations and new NTS filings also are adding a different wrinkle.

You will see new notices of trustee sale come out as trustees move the sales to new locations on existing

foreclosures.

We are also seeing more republishing than in previous years due to sales being contested and trustees having to

cancel sales and file a new NTS under the same file number in response to legal proceedings and files going beyond

one year from the original sale date.

Such changes are making it difficult to track a sale, especially as the websites who carry information can often feature

the results of the old sale as well as the new sale information.  If these records contain the same APN and TS Number,

It can create confusion.  We often see two records for the same sale on the posting sites when this happens.

Our tip is this:  Look at the most recent documents.  Every profile has an added or listed date, which refers to the date it was posted on our website.  This is BIG.  Refer to the most recent NTS ONLY.  It will have the current info. on the sale date and location.  If for any reason it appears that the sale date has not yet passed, but we are showning a SOLD or SOLD TO BENEFICIARY or CANCELLED status, call us.  We are scrubbing our data for these anomalies by removing the older record, but it is possible to miss some, as we have so many these days. 

We will review and correct the record upon request if we have not done so already.

"Foreclosure Auctions Banned from Courthouse Steps"

Here are a few comments from us, but you should read her article and make your own opinion.

These are not direct quotes, but a response to the article itself: 

The San Diego County Sheriff's Department is the latest local government entity to deem Foreclosure Auctions a nuisance on their watch.  They have pushed for and gotten a ban from Superior Court Judge Kevin A. Enright on Trustee's Sales on the San Diego Courthouse grounds.  In our opinion, this is not an effort to stop the auction process in San Diego County, it is an effort to save nominal budget costs and compel the lenders to provide their own security.

As the article states, Riverside and Los Angeles County Employees have already forced the Trustees attempting to hold lawful sales in their jurisdictions to move to alternate locations.  While this demonstrates a concerted effort by the public employees in the state to cut their excess workloads and stop providing security for the sales at public facilities,  it will not stop the sales themselves. 

What we are likely to see are more independent auction venues, like we see from companies like www.Auction.com .

If that is the case, costs related to security may end up being added to the cost of a foreclosure, as it is the county government which is now creating this additional cost for lenders.  We are also likely to see efforts by counties and cities to charge for permits and fees for these independent venues as their inability to fix their broken budgets becomes more pronounced.    We will be watching these changes closely.  It is clearly a work in progress.

Most news stories about foreclosures contain misleading stories to present the borrower as a victim.  This is almost never true.  The bank is usually the victim, and sometimes that bank is an individual who is being punished by losing his/her entire investment because they trusted a person who thinks contracts are like ice cream... easily melted.  

You may argue against this perspective, but the facts support it, again and again.

Take a recent property that sold in Whittier...

The borrower showed up to protest the bank on and got on the news to say the bank was unfair and sold her property for half of what she owed. 

The truth is...  There were 2 active loans and the 1st foreclosed, wiping out itself and a larger 2nd loan.  What was owed was a total slightly above market value, but it was from two refinance loans where the family had taken out the money as income to spend.  Once they spent the money, they now owe over $400,000.00... but the house is now worth a little less, and if they can’t borrow more money, they refuse to make payments.  Nice.

AND they blame the bank for their poor choices, when the bank can do nothing but react to those choices.

The first of $165,000.00 foreclosed and could only ask for what was owed.  The family had every chance to bring the loan current for a very small amount and stop the foreclosure.  THEY CHOSE Foreclosure. 

If they had gathered just around $10k of the $250k they had "borrowed" on the 2nd refinance loan they could have made one payment and still own the property. 

The bank would see this an attempt to demonstrate good faith and perhaps do more on their end.  They were not that far out of whack, so a modification could have happened.  The trustee wants this to happen, as does the lender.  Only the homeowner is in a position to force the auction by refusing to be reasonable. 

It appears that they chose not to be, and the bank was left with little option but to continue the foreclosure action.

So the house was lost.  It was the borrowers' choice.  Not the bank. Not the bank.

809 N Rose St. in Escondido is a 3BR/2BA Home.  The loan from 6/22/06 was for $544,185.00.

The Est Bid for the auction on 6-8-10 is only $144,698.00  !!!

We suspected an error so we re-checked our own research.  We were correct.

This was a reverse mortgage.  This is a first TD.

14670 La Mesa Rd in Victorville is a 4BR/2BA Home.  The loan from 11/16/2004 was for $300,000.00.

The Est Bid was $216,716.90, but the NOD and the NTS were one single document that is called a notice of default AND foreclosure sale...  that was recorded just one month prior to the auction.  And the Notice stated that you could make a bid with only a 10% deposit at the courthouse in Chino. 

This did not match the legal requirements for a trustee sale, so we called the Trustee to advise of our concern about the legality of a sale without the formal 90 days between the NOD and NTS.

The "Trustee" was not a trustee at all.  They are an agent of the Secretary of HUD.  Not only was this another reverse mortgage, this was a HUD foreclosure...  Ordinarily we do not see these in our system.

The sale took place on 5/25/10 and HUD took the property.

Keep an open mind when you look at your data.  There is always the potential to learn something new.

There is no typo here.  The two condo's in the same complex sold the same day for the same price. 

The lesson here is that the lenders do have standards and guidelines they follow.  It may seem like there is no method to the madness at times, but there surely is.  They are creating a distressed sale value based upon broker's price opinions and comps from nearby properties.  If they have decided to make it a deal so they do not have to absorb another reo property.  If you follow the results of previous sales in a given area, you are bound to discover trends and patterns that you can use to your advantage.
